Digitally Native, Inc. ("Digitally Native," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, and the choices you have. It applies to digitallynative.io and to messaging programs, websites, and AI systems that Digitally Native operates on behalf of clients (each, a "Client Program") where this policy is referenced.
1. Information We Collect
We collect information you provide directly to us, information collected automatically when you interact with our services, and information from third parties.
Information you provide
- Contact details such as name, email address, phone number, and company.
- Information submitted through forms, including discovery requests, audit requests, and inbound inquiries.
- Information shared during phone calls, video calls, or messaging exchanges.
- For Client Programs: information you provide when you opt in to receive text messages, schedule appointments, request information, or interact with an AI agent or chatbot operated by Digitally Native on behalf of a client.
Information collected automatically
- Device and usage data such as IP address, browser type, pages viewed, referring URLs, and timestamps.
- Cookies and similar technologies for analytics and conversion tracking, including the Meta Pixel.
Information from third parties
- Business contact information from publicly available sources or business data providers used for prospect research.
- Information from telephony, email, calendar, and AI service providers we use to deliver services.
2. How We Use Information
- To provide, operate, and improve our services and Client Programs.
- To respond to inquiries, schedule meetings, and deliver requested information.
- To send transactional and program-related text messages where you have opted in. See the SMS section below.
- To send service-related emails and, where permitted, marketing communications you can unsubscribe from at any time.
- To measure performance, secure our systems, and meet legal obligations.
3. SMS / Text Messaging Programs
This section applies to text messaging programs operated by Digitally Native, including those operated on behalf of clients such as Brothers Daley restaurant (brothersdaley.com) and Charm Aviation (flycharmny.com).
Consent and opt-in
Digitally Native and the businesses we operate messaging programs for will only send SMS or MMS messages to phone numbers that have provided prior express consent. Consent is collected through means such as completing a web form, submitting a missed call, replying to an inbound message, or providing a phone number at a point of service. Consent to receive SMS messages is never a condition of purchase.
Program description
SMS programs operated by Digitally Native are used to send appointment confirmations, missed-call follow-ups, booking reminders, customer service replies, transactional notifications, and, where you have separately opted in, marketing or promotional messages from the operating business.
Message frequency
Message frequency varies based on your interactions with the operating business. Typical programs send between 1 and 10 messages per month per recipient.
Message and data rates
Message and data rates may apply, depending on your mobile carrier and plan. Digitally Native and the operating business are not responsible for carrier fees.
Opt-out (STOP) and Help (HELP)
You can cancel an SMS service at any time. Reply STOP to any message to unsubscribe. After replying STOP, you will receive one final confirmation message and will receive no further messages from that program. To rejoin, sign up again as you did originally.

Carriers and supported networks
Carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, and other major and minor U.S. wireless carriers, are not liable for delayed or undelivered messages.
Privacy of mobile information
Mobile information collected as part of an SMS program (including phone numbers and consent records) is not shared, sold, rented, or transferred to third parties for the purpose of marketing, promotional, or lead-generation. Information may be shared with subprocessors strictly to operate the messaging program (for example, the SMS gateway and CRM platform we use to deliver messages on behalf of the client). This restriction is not affected by other parts of this Privacy Policy.
4. How We Share Information
- Clients. When Digitally Native operates a messaging program, AI agent, or website on behalf of a client, the information you submit is shared with that client because you are interacting with their business. The client is the primary controller of that information.
- Service providers. Hosting, analytics, AI inference, telephony, SMS gateway, email delivery, payment, scheduling, and CRM providers that help us run our services. These providers are contractually limited to using the information to provide services to us.
- Legal and safety. Where required by law, subpoena, or to protect rights, safety, or property.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality protections.
- We do not sell personal information. We do not share personal information for cross-context behavioral advertising as those terms are defined under U.S. state privacy laws.
5. Cookies and Analytics
Our website uses cookies and similar technologies to measure usage and performance. We use Meta (Facebook) Pixel for conversion measurement on our own marketing. You can disable cookies in your browser settings; some site features may not work as expected if you do.
6. Your Choices and Rights
- Email. You can unsubscribe from marketing emails using the link in any message. We will continue to send service-related and transactional messages.
- SMS. Reply STOP to any message at any time. See section 3 above.
- Access, correction, deletion. Subject to applicable law, you may request access to, correction of, or deletion of personal information we hold about you. Email hello@digitallynative.io. For Client Programs, requests may be routed to the operating business as the primary controller.
- State privacy rights. Residents of California, Colorado, Connecticut, Virginia, Utah, and other U.S. states with comprehensive privacy laws may have additional rights. Email us to exercise them. We will not retaliate against you for exercising these rights.
7. Data Retention
We retain personal information for as long as needed to provide our services, comply with legal obligations, resolve disputes, and enforce agreements. SMS opt-in records and message logs are retained for the period required by carrier compliance rules and applicable law.
8. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is fully secure, and we cannot guarantee absolute security.
9. Children
Our services are not directed to children under 13, and we do not knowingly collect personal information from children. If you believe a child has provided personal information to us, contact us and we will delete it.
10. International Users
Digitally Native is based in the United States. By using our services, you consent to the transfer of your information to the United States and to processing under U.S. law.
11. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the latest version. Material changes will be communicated by posting a notice on this page or, where appropriate, by direct notice.
